These Terms and Conditions govern your use of our website (https://www.basantenvelopes.com) and the services we provide, including but not limited to envelope manufacturing, offset printing, variable data printing, and mailing services. By accessing our website or engaging our services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services.
Client: The individual or entity placing an order or engaging our services.
Services: All products and services provided by Basant Envelopes N Print Ltd., including envelope manufacturing, printing, and mailing solutions.
Order: A request for services or products placed by the Client through our website, email, phone, or other communication channels.
We provide customized envelope manufacturing, offset printing, variable data printing, and mailing services as per Client specifications. All services are subject to:
Quotation and Approval: Orders require a written quotation from us and Client approval before processing.
Specifications: Clients must provide accurate design, content, and specifications for all orders. We are not responsible for errors in Client-provided materials.
Delivery: Delivery timelines are estimates and subject to production schedules and logistics. Delays due to unforeseen circumstances (e.g., supply chain issues) are not our liability.
Order Process: Orders may be placed via our website, email (benplimited@gmail.com), or phone (+918045477718). All orders are subject to acceptance by us.
Confirmation: Orders are confirmed only upon receipt of a written order confirmation from us, including agreed pricing and specifications.
Cancellation: Orders may be canceled by the Client within 24 hours of confirmation, subject to a cancellation fee if production has begun. Cancellations must be communicated in writing.
Pricing: Prices are as per the quotation provided. Additional costs (e.g., for revisions or expedited delivery) will be communicated and require Client approval.
Payment Terms: Payments are due as per the terms specified in the quotation or invoice, typically within 30 days of invoice issuance. For Micro & Small Enterprises, payments must comply with MSME regulations (e.g., within 45 days to avoid penalties).
Late Payments: Overdue payments may incur interest at 1.5% per month or the maximum rate permitted by law.
Taxes: All prices exclude applicable taxes (e.g., GST), which will be added as per Indian tax regulations.
Quality Assurance: We strive to deliver products and services meeting the agreed specifications. Minor variations in color, size, or finish inherent to the printing process are not considered defects.
Client Responsibility: Clients are responsible for reviewing and approving proofs before production. We are not liable for errors in approved proofs.
Defective Products: If products are defective due to our error, we will replace them or issue a refund at our discretion, provided the Client notifies us within 7 days of delivery.
Limitation of Liability: Our liability is limited to the order value. We are not liable for indirect, consequential, or incidental damages, including loss of profits or business opportunities.
Client Content: Clients warrant that all materials provided (e.g., designs, logos, text) do not infringe third-party intellectual property rights. Clients indemnify us against any claims arising from such content.
Our Materials: All designs, templates, or tools created by us remain our property unless otherwise agreed in writing.
Usage Rights: Upon full payment, Clients receive a non-exclusive license to use the delivered products for their intended purpose.
Delivery Terms: Delivery is arranged as per the agreed terms in the quotation. Shipping costs are borne by the Client unless otherwise specified.
Risk of Loss: Risk of loss or damage transfers to the Client upon delivery to the carrier or Client’s designated location.
Delays: We are not liable for delays caused by third-party logistics providers or force majeure events (e.g., natural disasters, strikes).
By Client: Clients may terminate an order subject to cancellation policies (see Section 3).
By Us: We reserve the right to terminate an order or refuse service if the Client breaches these Terms, fails to make payment, or provides misleading information.
Effect of Termination: Upon termination, the Client remains liable for any outstanding payments or costs incurred.
We are not liable for failure to perform our obligations due to events beyond our control, including but not limited to natural disasters, government restrictions, or supply chain disruptions.
Governing Law: These Terms and Conditions are governed by the laws of India, with exclusive jurisdiction in the courts of Mumbai, Maharashtra.
Dispute Resolution: Any disputes arising from these Terms or our services will be resolved through negotiation. If unresolved, disputes will be subject to mediation or arbitration in Mumbai before proceeding to litigation.
We may update these Terms and Conditions from time to time. The updated version will be posted on our website with the “Last Updated” date. Continued use of our website or services constitutes acceptance of the revised terms.
